QLD 536 David Andrew Gardiner Bailed
29 July 2013
The man at the centre of a love triangle responsible for the discovery of $2 million of suspected stolen property has been given bail on condition he live with his estranged wife.
David Andrew Gardiner looked at his wife of three years, Bianca Rinaudo, as he fronted the Brisbane Magistrates Court for a third time in four days on Monday – this time on drug production and trafficking charges.
Gardiner, 35, was first before court on Friday after being arrested when millions of dollars in property was found in his rented sheds, on Brisbane’s southside, so over-laden with valuables it has been dubbed ”an Aladdin’s Cave”.
While Gardiner attempted to communicate with Ms Rinaudo from the glass-enclosed dock of Magistrates Court No. 3, she sat quietly in the public gallery with an as yet unidentified man.
Gardiner was not required to enter a plea to 13 new charges, including trafficking, producing, supplying and possessing dangerous drugs, possessing explosives, illegal weapons and documents that instruct on how to produce dangerous drugs.
Police did request Gardiner be refused bail, saying the fact that his tally of serious offences had climbed to 35 and that he was a risk of committing further offences.
However, Magistate Chris Callagahan rejected the application, saying nothing had changed in circumstances since Gardiner was granted bail by another magistrate at the weekend.
Solicitor Lyle Parker, for Gardiner, said his client did want to alter his bail address so that he could live with Ms Rinaudo.
Ms Rinaudo, when approached by police prosecutors, said she was happy to not only provide Gardiner with a home, but also provide for him financially.
Gardiner’s co-accused and the so-called third link in the love triangle – Brodie Lea Swan – has also been charged with a swag drug offences.
Swan, 22, has fronted court and will reappear on the same charge.
Property unearthed by police inside Gardiner’s sheds included up to 40 motorbikes, cars, electrical goods and jewellery worth in excess of $1 million.
Gardiner, a custom car builder, operated a second-hand goods business from several rented properties on Musgrave Rd at Coopers Plains.
Ms Rinaudo, who is understood to be trying to save her marriage after the pair split earlier this year, sat inside the court wrapped in a leopard print scarf that she used to disguise her husband’s head when he was released on bail on Saturday.
Ms Rinaudo, a model and business owner, said Gardiner could reside at her residence at Sherwood, in Brisbane’s west.
Both have been remanded to appear on 16 August 2013.
